Systemic risk rules apply regardless of open-source licensing

Regulation (EU) 2024/1689 - Artificial Intelligence Act · Preamble

General-purpose AI models, in particular large generative models, could pose systemic risks despite being released under a free and open-source licence. Such licence may relate both to the model weights and the underlying parameters, as well as, where applicable, other relevant information enabling investigation and reproducibility. It is therefore important in terms of legal certainty that where general-purpose AI models are released under free and open-source licences, those models should be subject to the obligations laid down in this Regulation on the basis of the same criteria used for other general-purpose AI models to establish the extent of obligations.
