Based on information relevant to the classification of a general-purpose AI model, the Commission may conclude that a general-purpose AI model presents systemic risks, even if the model does not meet the presumption threshold for a general-purpose AI model with systemic risks laid down in this Regulation. On the basis of an overall assessment, the Commission should take into account the criteria for the designation of a general-purpose AI model as a general-purpose AI model with systemic risk set out in an annex to this Regulation.
