In order to ensure a consistent and efficient conduct of market surveillance by market surveillance authorities under this Regulation, it is important to clarify the rights of access of market surveillance authorities to the AI system, including to the source code and related documentation, and to corresponding data that is used by the provider, the processes for training, testing and validation of the respective AI system, and, where relevant, the corresponding datasets.
