Given that in certain circumstances, full access to an AI system or its underlying data may not be necessary for the market surveillance authorities to perform specific market surveillance activities, this Regulation should not be interpreted as limiting the ability of the deployer or the provider to restrict access to ensure confidentiality or to facilitate effective market surveillance activities under this Regulation. Where confidential information can be extracted and analysed in a manner that preserves confidentiality, supervision of compliance with obligations under this Regulation should not be hindered by such confidentiality concerns.
