Purpose of deep fake transparency obligations

Regulation (EU) 2024/1689 - Artificial Intelligence Act · Preamble

Obligations placed on providers and deployers of certain AI systems in this Regulation to enable the detection and disclosure that the outputs of those systems are artificially generated or manipulated are relevant to help address the risks from deep fakes. Deep fakes, or the use of AI to create fake imagery, audio or video content that convincingly depicts actual people doing or saying things they never did or said, pose specific risks related to impersonation and deception. The wide availability and capabilities of such AI systems may have significant impacts on the integrity and trust of the information ecosystem, the full enjoyment of fundamental rights, including freedom of expression and the right to receive and impart information, and may facilitate electoral interference. Citizens should have a right to know when they are exposed to synthetic content, deep fakes or other synthetic media, and should be able to identify such content. In the case of synthetic audio, visual or audiovisual content, the labelling or technique used should also be easy to perceive for a person with a visual or hearing impairment. Given the diversity and scale of the online information ecosystem, those risks cannot be fully addressed through transparency obligations alone, and might require the use of other mitigating measures such as fact-checking and media literacy, awareness-raising campaigns, misinformation detection technologies as well as measures to address specific risks in particular political, election and education contexts, including measures aiming at protecting the electoral processes.
